The COVID-19 public health emergency is unprecedented on many fronts, threatening the life and health of people around the world. The situation is very fluid, with federal and state guidance changing almost daily regarding how to provide appropriate care for those in need.
LeadingAge Florida has asked for the level of legal immunity needed to ensure that caregivers can focus on taking the necessary steps to care for the highest-risk populations in these extraordinary conditions.
A request for limited immunity from liability for actions taken to mitigate COVID-19 is not unique, and other states have already provided such protections. New York, Michigan, Kentucky, Illinois, Indiana and Louisiana have enacted policies to provide immunity from liability for caregivers in their efforts to reduce the impact and slow the spread of the coronavirus.
