WHY: Provide briefing on critical legislative priorities to preserve the quality of life for Floridians with developmental disabilities

The Florida Developmental Disabilities Council (FDDC), The Arc of Florida (Arc), individuals with developmental disabilities, their families, caregivers, advocates and friends will gather Tuesday, March 21, at 10:30 a.m., in the Capitol Courtyard – Senate Side (or, in case of rain, on the second floor of the Capitol) for a press conference during the 2017 Developmental Disabilities Awareness Day. FDDC and The Arc of Florida are partners in this annual event which aims to generate awareness and provide information about the importance of inclusion and funding essential services for individuals with developmental disabilities. 

Speakers will include advocates, self-advocates, legislators, Arc Board and FDDC Council members. Those present will ask the Florida Legislature to ensure that individuals with intellectual and developmental disabilities and their families who receive the Individual Budgeting/Home and Community Based Services Waiver have stable and qualified service provider staffing for delivering waiver services by increasing provider compensation. They also will ask the Legislature to consider continuing its support of a meaningful long-term commitment to reducing the Waiver waitlist. Reporters will have the opportunity to interview Council members and individuals and providers affected by the provider rate issue.

In addition, two awards will be presented by FDDC during the press conference: the 2017 Idelio Valdes Leadership and Advocacy Award, named in honor of the late former Council member and self-advocate, will be presented to Sarah Goldman of Tampa and a special recognition of Arc and APD staff who have put together a choking prevention initiative.

The day’s activities also include:

•    Exhibits: 8:30 a.m. – 3:00 p.m., second floor Capitol Rotunda

•    Press Conference and speakers: 10:30 a.m. – 1:30 p.m., Senate Portico 

•    Luncheon: 12 p.m., Senate Portico 

•    Advocate visits with legislators: throughout the day

Woman Arrested for Travel Fraud Scheme

Attorney General Pam Bondi’s Office of Statewide Prosecution and the Florida Department of Law Enforcement today announced the arrest of Maria Constanza Shults in connection with an organized travel fraud scheme operating in north and central Florida. According to the FDLE investigation, Shults, 62, of Jacksonville, operated an organized scheme defrauding a total of 27 known victims of more than $100,000. Shults’ scheme targeted Catholic parishioners by offering trips to holy sites.
“Preying on people’s religious faith to defraud them will not be tolerated and my Office of Statewide Prosecution will aggressively prosecute this case,” said Attorney General Bondi. “Thanks to a great partnership with the Florida Department of Law Enforcement, this travel fraud scheme has been shut down.”
“Fraud can take many forms and in this case, it preyed on the trust of unsuspecting Florida citizens. FDLE is committed to fighting this crime and I am grateful for the hard work of our agents and the diligence of the Office of the Attorney General,” said FDLE Commissioner Rick Swearingen.
From 2012 through 2015, Shults allegedly proposed trips to Catholic parishioners to holy sites in countries such as Israel, Italy and Portugal. After collecting payments ranging from $2,500 to $7,000 from the victims, Shults allegedly canceled the trips without refunding the victims’ money.
Shults faces one count of organized scheme to defraud in excess of $50,000. The Attorney General’s Office of Statewide Prosecution will prosecute the case. The Florida Department of Law Enforcement investigated the case.

$54,000 FANTASY 5 ticket set to expire

The Florida Lottery today announced that a FANTASY 5® top prize-winning ticket worth $54,016.33 remains unclaimed. The 180-day deadline to claim the top prize is Wednesday, March 29, 2017, at midnight ET.
The winning FANTASY 5 numbers for the September 30, 2016, drawing were:

05 – 10 – 20 – 30 – 33           

The winning free Quick Pick ticket was sold at Sunshine, located at 7191 Pembroke Road in Pembroke Pines. Players who may have purchased a FANTASY 5 ticket at this retail location are encouraged to check their tickets for the September 30 drawing.
While any Florida Lottery retailer can validate the winning ticket, the FANTASY 5 top prize must be claimed at a Florida Lottery district office or at Florida Lottery Headquarters in Tallahassee. Players can obtain additional information by calling the Lottery’s Customer Service Department at (850) 487-7787 or visiting the Florida Lottery’s website at www.flalottery.com.
FANTASY 5 is a pari-mutuel game in which players win the top prize by matching 5-of-5 winning numbers drawn in any order. Additionally, players win cash prizes or a free Quick Pick ticket by matching two, three or four of the numbers drawn in the official drawing for the date played. If there is no top prize winner, the money in the top prize pool rolls down and is shared among players who match 4-of-5 or 3-of-5 winning numbers.
Since the game’s inception, more than 705 million FANTASY 5 winners have won more than $4 billion in prizes. Of these, more than 51,000 players have won top prizes totaling more than $2.3 billion.

FWC encourages boaters to ‘Spring Aboard’ by taking a boater education class

World-class fishing, crystal blue waters, endless sunshine – there’s so much about Florida’s waterways to enjoy. During the week of March 19-25, the National Association of State Boating Law Administrators and the Florida Fish and Wildlife Conservation Commission (FWC) encourage all boaters to take part in the national “Spring Aboard” campaign by taking a boating safety course.
“We know that an educated boater is safer on the water. If a boat operator has taken a boating safety education course, the likelihood of their time spent on the water being a safe and enjoyable experience is much greater for them as well as their passengers,” said Stephanie Weatherington, president of NASBLA. “March is the perfect time to take a course before the summer boating season begins.”
Many course providers will offer incentives or course discounts for students who enroll in or complete a course during the “Spring Aboard” campaign. For a summary of Florida’s regulations and available courses, go to MyFWC.com/Boating.
“In Florida, boaters who were born on or after Jan. 1, 1988, are required to complete and pass a boater safety education course. But everyone interested in boating should take a course – it’s the smart thing to do,” said Maj. Robert Rowe, FWC’s Boating and Waterways section leader. “Boaters have many ways to get educated, from classroom courses offered by the U.S. Coast Guard Auxiliary and United States Power Squadrons to online offerings available anytime day or night. There’s no reason to head out on the water without this knowledge.”
Florida boating accident statistics from 2015 indicate that, when the level of operator education was known, 72 percent of boating deaths occurred on boats where the boat operator had never received boating education instruction.

UCF 1st in State to Offer Neurofeedback Therapy to Aid Students’ Mental Health

The University of Central Florida recently became the first public university in the state to offer students neurofeedback therapy, a treatment for various mental-health disorders that helps patients gain more control over their brain activity.
UCF’s addition of neurofeedback therapy comes at a time when demand for mental-health services on college campuses is on the rise across the country. More than 58 percent of college students reported overwhelming feelings of anxiety in the previous 12 months in a spring 2016 National College Health Assessment report created by the American College Health Association. That’s up from the 50.6 percent of students who reported overwhelming anxiety in spring 2011. Feelings of depression also have risen: 36.7 percent of students reported high levels of depression in a spring 2016 report compared to 31.1 percent in spring 2011.
The neurofeedback therapy at UCF is housed in a 10,000-square-foot addition of the on-campus Health Center that opened in November.
Anxiety, depression, attention deficit hyperactivity disorder and substance abuse are common mental health issues that neurofeedback therapy can help. Electrodes measure brain waves in real-time as a patient works through a task such as flying a character through hoops in a video game using just his or her mind. Patients receive positive visual and audio feedback when they direct the character through a hoop, for example, but when the patient’s mind wanders from the task at hand, the character veers off course. Over numerous therapy sessions, this can improve a patient’s self-regulation skills and ability to control anxiety, emotions and attentiveness through operant conditioning.
“Worrying or racing thoughts often are tied with college students. Even in individuals who are high achievers, it can be hard to quiet their mind,” said Collier Shepard, mental-health counselor and biofeedback consultant at the Health Center. “Neurofeedback can help people calm their mind and get rid of excessive thoughts.”
Neurofeedback therapy also can detect if a patient has an imbalance of brain waves. Using data generated from the electrodes, it can be determined if too much or too little brainwave activity is present in different locations of the brain. Irregular activity can be associated with symptoms of anxiety, depression and inattentiveness, and if identified, personalized neurofeedback training can help get a patient to a more balanced mental state.
Shepard has seen neurofeedback help one patient reduce daily migraines to once or twice a month, plus improve his overall mood. Neurofeedback also helped a patient reduce her symptoms of anxiety and depression, so much so that she was able to cut back on antidepressant medication she’d been taking for seven years.
“This gives students another option who haven’t responded well to other therapies,” Shepard said. “It’s neat to have this offered on a college campus.”
Karen Hofmann, director of UCF Counseling and Psychological Services, added: “It’s a great thing to have multiple referral options for students that fit the needs of what the student is struggling with. Anxiety, in particular, is the No. 1 presenting issue seen at CAPS.”
Neurofeedback therapy is offered only by a handful of practitioners in Central Florida. A session often costs $75-$125, Shepard said, but UCF students paying tuition have the therapy available to them for no extra cost.
UCF began offering the neurofeedback therapy in 2016 to substance abuse patients on an as-needed basis, but with the expansion of the Health Center, resources now are available to offer the therapy full time and for more mental-health disorders. The number of patients is expected to rise from three per week to 12, and individual sessions per month are expected to increase from 20 to 80, said Thomas Hall, director of Substance Abuse Prevention Education, Treatment & Recovery Services at UCF.
“UCF’s mental health support is the most progressive among Florida universities by far,” Hall said.

Consumers Win In Gulf Power Settlement

Proposed Drastic Fixed Charge Hike Rescinded

In a settlement to a challenge mounted by the Southern Alliance for Clean Energy and the League of Women Voters of Florida, represented by Earthjustice, Gulf Power has agreed to rescind a drastic fixed charge hike proposal that would have hurt customers.
“We are glad that Gulf Power has agreed to do the right thing,” said Earthjustice attorney Bradley Marshall. “Raising this fixed charge on monthly bills would have unfairly penalized people who use less energy, and that makes no sense.”
Gulf Power wanted to increase the monthly fixed charge on its residential customers’ bills from the already high amount of about $18 to nearly $50. This rate restructuring proposal was unprecedented nationally and would have hit families on low and fixed incomes hard.
“The voices of the citizens were instrumental in this decision. This shows that people are paying attention, getting educated on issues that affect them and speaking out,” said Pamela Goodman, President of the League of Women Voters of Florida. Leading up to the hearing, Gulf Power customers were very vocal in their opposition to the proposal, providing comment at public hearings in Panama City and Pensacola, as well as sending over 1,000 letters to the Public Service Commission.
“We are pleased to see Gulf Power withdraw the unprecedented fixed charge increase from their rate proposal,” said Dr. Stephen Smith Executive Director, Southern Alliance for Clean Energy. “We firmly believe excessive fixed charges prevent consumers from being able to manage their bills with common sense actions like investments in energy efficiency and solar self generation. As rates continue to go up, consumers need the freedom and flexibility to control their cost while protecting the environment.”
The Southern Alliance for Clean Energy and the League of Women Voters of Florida applaud the abandonment of this unfair rate restructuring, but due to other concerns were unable to sign the settlement agreement.
The hearing is scheduled to begin on March 20th at 1 P.M. at which time the parties will present the settlement to the Public Service Commission.

US 41 at Gulfstream Avenue Public Meeting Scheduled

The Florida Department of Transportation (FDOT), District One, is hosting a public information meeting as part of the Project Development and Environment (PD&E) study to evaluate improvements to the intersection at US 41 and Gulfstream Avenue in the City of Sarasota. The meeting will be Tuesday, March 28, 2017 at the Sarasota Municipal Auditorium, 801 N. Tamiami Trail, Sarasota, Florida.
The meeting will be an open house format from 5 p.m. – 7 p.m. where people can ask questions and provide comments to FDOT representatives in a one-on-one setting. FDOT will accept written comments during this meeting. FDOT will show a video running on a continuous loop that describes the alternatives developed during the PD&E study.
FDOT is sending notices to property owners located within at least 300 feet of the intersection, including residents along Sunset Drive and Golden Gate Point. We encourage all interested people to attend and express their views regarding the project and information presented.
FDOT solicits public participation without regard to race, color, national origin, age, sex, religion, disability, or family status. FDLE arrests woman for organized travel fraud scheme

FDLE agents arrested Maria Constanza Shults, 62, of 10834 Rutherford Court, Jacksonville, on one count of organized scheme to defraud in excess of $50,000, where she sold pilgrimages to religious sites, then canceled the trips without refunding the victims’ money.

“Preying on people’s religious faith to defraud them will not be tolerated and my Office of Statewide Prosecution will aggressively prosecute this case,” said Attorney General Pam Bondi. “Thanks to a great partnership with the Florida Department of Law Enforcement, this travel fraud scheme has been shut down.”

Throughout 2015, Shults proposed trips to Catholic parishioners to holy sites in countries such as Israel, Italy and Portugal. Shults collected payments averaging from $2,500 to $7,000 from the victims and then canceled the trips without refunding the victims’ money. Through its investigation, which began in September 2015, FDLE identified 27 known victims throughout multiple circuits in North and Central Florida with a total loss of over $106,000.

Shults was arrested on Friday and booked into the John E. Goode Detention Facility, Jacksonville, Florida.

The case will be prosecuted by the Office of Statewide Prosecution, Jacksonville.

Florida National Guard Day in Tallahassee

Annual event at Capitol highlights Guard’s contribution to State and Nation

WHAT: The Florida Department of Military Affairs and the Florida National Guard will host “Florida National Guard Day” at the Capitol.
WHEN: Tuesday, March 21, 10 a.m. until around 2 p.m.
WHERE: The State Capitol complex (courtyard), Tallahassee.
The Florida National Guard will begin bringing displays to the Florida’s Capitol, Monday afternoon, with Soldiers, Airmen and their representative equipment in support of its annual Florida National Guard Day, held Tuesday.
The Department of Military Affairs and the Florida National Guard sponsor the visit to Tallahassee as part of an annual program to educate the public and government personnel on various roles and missions of the Guard. The event also allows the Florida National Guard to thank the community for its continued support.
The day’s events include:

  1.  The Florida National Guard’s 13th Army Band from Miami will present a program of military music during the lunch hour while Soldiers serve hotdogs and beverages.
  2. In the Capitol plaza, the Guard will display an assortment of military equipment used during emergency and combat operations.
  3. Information displays that describe the important community service programs run by the Guard will be located in the Capitol rotunda.

In preparation for the event, there may be increased traffic in the Capitol area Monday and Tuesday afternoon as equipment is transported to and from the Capitol complex.
