Commissioner Stewart Recognizes Outstanding School Volunteers

Commissioner of Education Pam Stewart today recognized outstanding school volunteers at the youth, adult and senior levels from across the state. The Outstanding School Volunteer award is presented each year to school volunteers who have exhibited exceptional commitment to quality education in Florida.
“School volunteers supplement the hard work Florida’s educators and school personnel do every day and help to fill the gaps when parents and guardians are not available,” said Commissioner Stewart. “I hope that the outstanding volunteers we are recognizing today will serve as an inspiration for all Floridians to get more involved in their communities.”
Awardees will receive a congratulatory letter from Commissioner Stewart and a mounted certificate, and are often recognized by the school district in which they volunteered. The list of winners and a brief summary of their service is posted at Outstanding School Volunteers.

Ramp Closures at US 1 and State Road 405

Nighttime ramp closures are scheduled for State Road (S.R.) 405/ Columbia Boulevard/ NASA Causeway and U.S. 1 from Monday, March 6 through Wednesday, March 15. The closures will take place nightly from 9 p.m. to 5 a.m. and will allow the contractor, Ranger Construction, Inc., to construct asphalt transitions to the recently paved U.S. 1 roadway.
The repair is part of the Florida Department of Transportation’s milling and resurfacing of U.S. 1 from north of Golden Knights Boulevard to south of S.R. 50.

S.R. 40 (Granada Boulevard) Bridge Repair Begins This Week

Contractors are starting repairs on the State Road (S.R.) 40 (Granada Boulevard) bridge over the Halifax River in Ormond Beach this week. The improvements in this project include installation of a post-tensioning support system and minor concrete repairs to Pier 8, located just west of the channel.
All work will be done behind the fender system to allow the channel to remain open at all times. The project will not impact the boat ramps, parks or piers at the west end of the bridge. Boat traffic is asked to use caution, and pedestrians need to be alert as equipment will be in the area.
To facilitate the work, contractor CMA Corporation will build a coffer dam around the pier.  The $1.75 million improvement project is expected to take about nine months to complete.
The construction schedule may be affected by weather or other unforeseen conditions. Updates can be found on the FDOT Central Florida website www.cflroads.com. Attorney General Bondi Recognizes Consumer Protection Week

Attorney General Pam Bondi is warning Floridians about the latest scams and highlighting some of her office’s more notable successes this Consumer Protection Week. Attorney General Bondi will also be reaching out to consumers directly through Twitter with tips to avoid becoming a victim of a scam. Since 2011, Attorney General Bondi’s Consumer Protection Division has conducted hundreds of investigations and recovered billions of dollars for Floridians.
“Whether it’s homeowners victimized by unfair mortgage servicing practices or people being exploited by price gougers during a state of emergency, we work tirelessly to protect all consumers,” said Attorney General Bondi. “This Consumer Protection Week, I want to thank the hard-working people in my Consumer Protection Division for their unwavering dedication to stopping deceptive and unfair business practices.”
The Attorney General’s Consumer Protection Division enforces Florida’s Deceptive and Unfair Trade Practices Act and, where possible, helps secure restitution for victims of consumer fraud and other prohibited acts under FDUPTA. Some of the office’s most significant cases include:

  • The National Mortgage Settlement, providing more than $9 billion in relief to struggling Florida homeowners;
  • Chase Bank Card Services, Inc., providing more than $19 million in relief to Florida consumers and non-profit programs and $1.6 million in penalties;
  • Suntrust Bank, providing more than $6.3 million in relief to consumers who lost homes to foreclosure;
  • Ocwen, providing nearly $16 million in relief to Florida borrowers, including debt forgiveness and other relief;
  • Rome Finance, a multistate settlement resulting in more than $92 million in debt relief to US service members nationwide, with more than $4 million to Floridians;
  • Volkswagen, a multistate settlement currently funding consumer restitution of more than $10 billion (up to $5,100 per car) nationally and providing car owners, including nearly 500,000 in Florida, the option to buy back the affected vehicle. Florida also obtained $32 million in civil penalties, fees and costs; and
  • Western Sky Financial and Cash Call Inc., a joint settlement with OFR in coordination with a class action that will provide more than $11 million in refunds to Florida borrowers and debt forgiveness of more than $15 million.

Attorney General Bondi’s Consumer Protection Division continues to aggressively pursue consumer fraud and other consumer protection violations affecting Floridians. Most recently, the division has focused on tech support scams, debt relief schemes, robocalling, travel scams and, during the recent hurricanes, price gouging.
Tech Scams: With at least nine cases filed, Attorney General Bondi’s Office has pursued more actions against tech support scam operations than any other state or government agency. Tech scams target consumers, particularly our seniors, through deceptive internet pop-up windows disguised as security warnings claiming the consumer’s computer is infected with malware. The consumer is then given a number to call for immediate help. The number connects the user to sales agents who use scare tactics to sell protection software or other services the consumer does not need.
Debt Relief Schemes: The division has also aggressively pursued debt relief and credit card interest rate reduction schemes that target Floridians already struggling financially. Operators of these schemes often make false statements and collect illegal upfront fees, frequently leaving consumers in even worse financial condition than before. A number of these companies are now banned from the industry thanks to joint legal actions taken by the division and the Federal Trade Commission. For a few recent examples, click here.
Illegal Robocalling: In partnership with the FTC, the division is also working to shut down illegal robocalling. Robocalling occurs when a consumer answers the phone and hears a pre-recorded message, usually selling or attempting to sell a product or service. These calls are an integral component of many unscrupulous schemes and are often used to facilitate credit card interest rate reduction scams, among others. Travel Scams: Florida’s visitors and residents alike are susceptible to these scams, which often start with enticing consumers to attend presentations with promises of free gifts—such as free cruises, airline tickets or gift cards—that are usually difficult or impossible to redeem. The high pressure sales pitches used in these presentations typically include offers of vacation club or travel club memberships, promising deep discounts. Often though, these alleged discounts are the same or even less than what consumers might find on their own. In the last year alone, the division filed four actions against travel clubs and promoters and reached settlements with three businesses securing more than $500,000 in consumer relief.
Price Gouging: When a state of emergency is declared, the Attorney General’s Office activates Florida’s Price Gouging Hotline. During a state of emergency, it is unlawful to sell or lease essential commodities at an amount grossly exceeding the average price for that commodity during the previous 30 days. In the aftermath of Hurricane Matthew, the division filed litigation against three hotels charging unconscionable room-rates, and other investigations are ongoing. Clean Energy Advocates, Solar Businesses Urge Swift Implementation of SB 90 as Florida’s Legislature Convenes

As the 2017 Florida Legislative Session begins tomorrow on Tuesday, March 7, clean energy advocates and solar businesses are urging elected leaders in Tallahassee to swiftly and cleanly implement Amendment 4, the solar tax abatement proposal, which passed in Florida’s August primary with 73 percent support.

An Amendment 4 implementation bill – SB 90 – was introduced in December by state Senator Jeff Brandes and has already passed two committees.

The next steps for SB 90 are hearings in the Finance and Tax Subcommittee, the Appropriations committee and then a vote before the full Senate. A companion bill in the House of Representatives is still pending, and expected to be filed by state Representative Ray Rodrigues soon.

Patrick Altier, President of FlaSEIA (a trade association representing solar photovoltaic and solar thermal contractors, installers, manufacturers, distributors, engineers, and designers) and an Ocala-based solar contractor said, “Voters across the political spectrum have demonstrated their strong support. It’s time for the Sunshine State to allow low cost solar and provide energy from a homegrown renewable fuel source to keep down energy costs.” 

“Given that the Florida legislature unanimously passed this measure last session and placed it on the ballot, we are optimistic that SB 90 will be quickly and cleanly implemented to enact the will of Florida’s voters,” said Susan Glickman, Florida Director foe the Southern Alliance for Clean Energy. “We will be on the lookout for any attempts to add provisions that might hinder solar development. Our goal is to ensure continued progress and the growth of Florida’s solar market.”

Secretary of State Ken Detzner issued the following statement encouraging business entities to file their annual reports early before the May 1 deadline. 
“All corporations, limited liability companies and limited partnerships transacting business in Florida must file an annual report between January 1 and May 1,” said Secretary Detzner. “I encourage these business owners to beat the rush and file their annual reports early before the May 1 deadline. The Department of State’s official and recently updated filing website, Sunbiz.org, provides a secure platform to file your report and is available 24 hours a day, seven days a week. The updated website offers an enhanced user experience with updated features, including a new countdown clock to help business owners remember the upcoming deadline. File Early Florida!”

3.6.2017 annual reports

Sunbiz.org, the state’s official filing website, features a new countdown clock to remind business owners of the upcoming May 1 deadline to file their annual report.

Annual reports must be filed each year between January 1 and May 1 to maintain an “active status” with the Department of State’s Division of Corporations. According to Florida law, a late fee will be imposed on all profit corporations, limited liability companies, limited partnerships, and limited liability limited partnerships which fail to file their annual reports on time. Additional information and instructions on how to file are available on the Division of Corporations’ website at Sunbiz.org.

Traffic shift opens second new Kirkman Road bridge

A traffic shift of southbound Kirkman Road (State Road 435) is scheduled for Thursday, March 9, as a second new bridge opens at the Kirkman Road and Interstate 4 (I-4) interchange.
Motorists should expect multiple lane closures during overnight hours on Wednesday, March 8, as the southbound lanes of Kirkman Road are shifted to a newly-constructed bridge over westbound I-4. The traffic shift is scheduled to be ready for morning commuters on Thursday, March 9.

The traffic pattern of southbound Kirkman Road is also changing after crossing over westbound I-4. See illustration in above link. Motorists are advised to maintain a safe speed when navigating this new temporary traffic pattern.
In November 2016, I-4 Ultimate crews opened the project’s first new bridge to motorists — the current northbound Kirkman Road bridge over westbound I-4. As part of the I-4 Ultimate project, more than 140 bridges will be widened, added or replaced when the project is completed in 2021.
Modifications or extensions to this schedule may become necessary due to weather delays or other unforeseen conditions. Motorists are advised to maintain a safe speed when driving through the work zone.

Results of Skimmers Sweep Targeting Popular Spring Break Destinations Announced

In anticipation of the upcoming spring break season, the Florida Department of Agriculture and Consumer Services inspected nearly 500 gas stations last week in popular spring break destinations for skimmers, devices that steal consumers’ credit and debit card information. Commissioner of Agriculture Adam H. Putnam announced today that the sweep uncovered eight skimmers. If undetected, the number of consumers victimized by each skimmer averages around 100 per device, with an average of $1,000 stolen from each victim.
“From Okaloosa County to Miami-Dade County, these skimmers are being placed on gas pumps and stealing from unsuspecting residents and visitors,” said Commissioner of Agriculture Adam H. Putnam. “We will continue to crackdown on these devices – and the criminals responsible for them.”
Since early 2015, the department has found and removed more than 430 skimmers across the state. The areas inspected in this sweep, the number of facilities inspected and numbers of skimmers found are as follows:

  • Panama City Beach/ Panhandle –77 facilities, 0 skimmers found
  • Orlando area – 128 facilities, 0 skimmers found
  • Clearwater / St. Pete Beach – 66 facilities, 4 skimmers found

In addition to regularly inspecting gas pumps, the department worked with the Florida Legislature last year to put in place additional safeguards against skimmers at the pump and increase the penalties against the criminals responsible.
There are steps consumer can take to protect themselves, such as:

  • Pay in cash inside the store to ensure the credit card information stays safe.
  • Check to make sure the gas pump dispenser cabinet is closed and has not been tampered with. Many stations are now putting a piece of security tape over the cabinet to ensure it has not been opened by unauthorized individuals.
  • Use a gas pump closer to the front of the store. Thieves often place skimmers at the gas pumps farther away from the store so they are not noticed as quickly.
  • Use a credit card instead of a debit card. Credit cards have better fraud protection, and the money is not deducted immediately from an account.
  • If using a debit card at the pump, choose to run it as a credit card instead of a debit card. That way, the PIN number is safe.
  • Monitor bank accounts regularly to spot any unauthorized charges.
  • Consumers who suspect their credit card number has been compromised should report it immediately to authorities and their credit card company.
