PSC Begins FPL Need Determination Hearing on Wednesday

The Florida Public Service Commission (PSC) will hold a hearing on Florida Power & Light Company’s (FPL) determination of need petition for the Dania Beach Clean Energy Center Unit 7 beginning at 9:30 a.m. on Wednesday, January 17, 2018.
During the hearing, the Commission will consider testimony from parties to the case about the proposed Dania Beach facility in Broward County.
The hearing is scheduled for the following time and location:

Campaign Passes $1 Million Cash on Hand

The Mast for Congress campaign today released the first ad of the 2018 campaign cycle, titled “Promises Kept.”  The 30-second spot highlights three bipartisan legislative achievements that fulfill major campaign promises: protecting seniors from fraud, preventing critical veterans programs from expiring and passing new funding to combat harmful algal blooms.
Additionally, after raising $419,000 during Q4 of 2017, the Mast For Congress campaign now has $1,039,000 cash on hand.

The ad references several pieces of legislation that fulfill campaign promises made by Congressman Mast:
FOR SENIORS

  • Congressman Mast has helped pass numerous pieces of legislation to protect seniors and strengthen Medicare, including:
    • The Elder Abuse Prevention and Prosecution Act promotes the investigation and prosecution of criminals who prey upon seniors, enhances data collection on crimes targeting seniors and provides additional resources for elder abuse prevention programs.  The bipartisan bill passed the House of Representatives on October 3, 2017, with Congressman Mast’s support, and was signed into law on October 18, 2017.
    • The Protecting Seniors Access to Medicare Act strengthens Medicare by eliminating the unaccountable and unelected Independent Payment Advisory Board.  The bill passed the House of Representatives, with Congressman Mast’s support, on November 2, 2017.
    • Medicare Part B Improvement Act helps ensure there aren’t gaps in coverage for Medicare beneficiaries and helps patients with chronic diseases more easily access their treatments.  The bipartisan bill passed the House of Representatives, with Congressman Mast’s support, on July 25, 2017.

FOR VETERANS

  • Congressman Mast introduced the Department of Veterans Affairs Expiring Authorities Act of 2017.  The bill extended a number of expiring programs impacting veterans healthcare and benefits, including homeless programs, nursing home care, child care assistance and home loan services.  The bill passed the House on September 25, 2017 and the Senate on September 27, 2017 with bipartisan support.  The Department of Veterans Affairs Expiring Authorities Act of 2017 was signed into law by the President on September 29, 2017.

FOR THE ENVIRONMENT

  • Congressman Mast has introduced and passed more than 10 amendments, totaling more than $20 million, to add funding to combat harmful algal blooms and clean up local waterways.  The programs include:
    • $8 million to the National Oceanic and Atmospheric Administration to combat harmful algal blooms.  Introduced with Congressman Vern Buchanan (FL-16).
    • $5.6 million for the Natural Resource Conservation Service to promote environmentally sustainable toxic runoff mitigation.
    • $2 million for the Agriculture and Food Service Initiative to expand research into prevention of harmful algal blooms.
    • $1.5 million for the Food and Drug Administration to research the health impact of contaminated seafood.
    • $1.1 million for the Environmental Protection Agency to research the impact on water quality of nutrient inputs.
    • $1 million for non-point source pollution mitigation grants, including removal of toxic substances.
    • $1 million for the U.S. Geological Service to research harmful algal blooms.
    • $1 million for the National Institute of Environmental Health Sciences to study the health impacts of exposure to harmful algal blooms.
    • $598,000 for the Department of the Navy to fund the Environmental Sustainability Development Project research on coastal contamination.
    • $500,000 for the Aquatic Plant Control Research Program to develop technology to combat harmful algal blooms.
    • $400,000 to the Centers for Disease Control to investigate environmental threats of public exposure to waterborne contaminates.

Caldwell Campaign Continues to Outraise the Field

Representative Matt Caldwell continues to outraise the field and build momentum in his bid for Commissioner of Agriculture. In December, Caldwell’s campaign and Political Committee raised a combined $101,701 and has over $1,078,762 million cash-on-hand.
Caldwell is running against Senator Denise Grimsley and former Representative Baxter Troutman in the Republican Primary. Senator Denise Grimsley, on the other hand, didn’t break the six-figure mark with her fundraising this month. In December, Grimsley’s campaign and Political Committee raised a combined $90,275 and has $872,278 cash-on-hand. In December, Troutman’s campaign and Political Committee raised a combined $7,875.
Brian Swensen, spokesperson for Caldwell’s campaign said, “Matt is the hardest working candidate in the race for Commissioner of Agriculture and continues to build momentum every day heading into the election year. He is outraising his opponents, has traveled more than 41,000 miles across the State since May, is the principled conservative in the race, and the only candidate that has consistently received an A rating from the NRA.”
The Commissioner of Agriculture serves as a member of the Florida Cabinet and is critical to the foundation of Florida’s economy. The Florida Department of Agriculture and Consumer Services helps the agricultural industry with its daily challenges, promotes Florida’s agricultural commodities, manages state forests, safeguards consumers, implements the school lunch program, and oversees the concealed-weapon license system.

Office and Cabinet Applaud the Passage of HB 7015 by House of Representatives

Office Releases Results of AOB Data Call

The Florida Office of Insurance Regulation (Office) and Cabinet applaud the actions of the Florida House of Representatives in passing legislation today to specifically address assignment of benefits (AOB) reform. House Bill 7015, which was sponsored by the Judiciary Committee, Representative Jay Trumbull, and Representative James Grant, and co-sponsored by Representative Jim Boyd, provides consumer protections and strengthens provisions in Florida law to reduce unnecessary litigation associated with AOBs that is causing an increase in homeowners insurance costs across the state.
Today, the Office released the “2017 Review of Assignment of Benefits (AOB) Data Call Report,” which provides aggregated results of information received by the top 25 personal residential insurance companies encompassing more than 85% of the Florida market and writing Homeowners and Dwelling Fire policies from January 1, 2015 – June 30, 2017. The findings of this report show a larger progression in the geographic spread, frequency, and average severity of water loss claims across the state; however, this occurred in half the time it took to develop when compared to the nearly six-year analysis of the February 2016 report on this same issue. Since 2015, results indicate the frequency of water claims has risen by 44% with all regions of the state experiencing double-digit increases. Likewise, the average severity of water claims has increased by 18%. The total combined impact of these changes reflect an average 42.1% annual increase in water losses, which is nearly triple the 14.2% average annual increase shown in the previous report.
“I am thankful for the support of the Cabinet, bill sponsors, and all House members who have been working hard to address AOB reform,” said Insurance Commissioner David Altmaier. “The results of my Office’s newest report is a clear sign that Florida is seeing an aggressive rise in the number of water loss claims associated with an AOB and this impact is being felt statewide. Without a legislative remedy, this problem will lead to an increase in homeowners insurance premiums and lack of consumer choice as insurers stop writing or renewing policies in areas with high water losses. I look forward to working with the Florida Legislature and other stakeholders on a proactive solution to address this issue in the 2018 Session.”

With skyrocketing homeowners insurance costs, consumers are on the losing end.“

Bad faith reform should not be left behind in PIP repeal legislation

The Florida House today voted to repeal Florida’s Motor Vehicle No-Fault Law and the PIP insurance requirement, passing HB 19 by a vote of 88 to 15. The bill, filed by Rep. Erin Grall (R-Vero beach), replaces the existing No-Fault/PIP system with a new, fault-based system that requires every motorist to buy bodily injury coverage of $25,000 per individual and $50,000 per accident. This insurance will cover third parties who are injured as the result of the negligence of the insured.
“Today, there’s a perverse incentive for third-party claimants to ‘set up’ the insurer of the person who is responsible for an injury or death arising out of a car crash, to recover extra-contractual damages – payments above the policy coverage amount,” said Michael Carlson, president of the Personal Insurance Federation of Florida (PIFF). “The goal of the claimant is to legally ignore the terms of the policy of insurance and obtain a higher judgment, which in turns increases the cost of insurance for all Floridians.”
PIFF said it urges lawmakers to include third-party “bad faith” reform in any repeal of the current system and weigh very carefully how moving to a new system will impact consumers. Without meaningful third-party “bad faith” reform, the new system could create new opportunities for claimants to abuse the current system, resulting in potentially higher BI claims settlements, which increase the cost of insurance.
A study by the Insurance Research Council found third-party “bad faith” lawsuits added $813 million in excess bodily injury claims costs in 2013. These litigation costs are then paid by all Florida drivers and — PIFF explains — must be addressed by legislators if they truly want to bring auto insurance costs down and create more choices and competition in the marketplace for Floridians.
As the debate on repealing PIP unfolds, the Personal Insurance Federation of Florida said it is committed to working closely with legislators to ensure that Florida’s motorists receive the best coverage at the best prices possible, while avoiding unnecessary mandated coverages and litigation costs. PIFF cautions the House to closely review what the Florida Senate might return in the coming weeks and urges the Legislature to include “bad faith” reform to lower the costs of insurance for all Floridians.

FDLE arrests Milton man for child pornography

Agents with the Florida Department of Law Enforcement today arrested Cesrow Reginald Freemont Crawley, 28, of 6553 Kennington Circle, Milton, for two counts of transmission of child pornography by electronic device.
Agents seized multiple devices for additional forensic analysis and future charges may be pending.
Crawley was booked into the Santa Rosa County Jail. The case will be prosecuted by the Office of the State Attorney, 1st Judicial Circuit.

Gov. Scott: ABC Home Medical Supply to Create 35 Jobs at New Corporate Headquarters in St. Lucie County

Governor Rick Scott today announced that ABC Home Medical Supply, a national supplier of specialty medical supplies, has selected St. Lucie County as the location for their new corporate headquarters. While the company considered other states like California and Pennsylvania, they ultimately chose Florida as the location for the expansion, which will create 35 new jobs. ABC Home Medical Supply will be expanding at its newly leased 11,000 square foot facility and currently employs 65 Floridians.

Statement by Commissioner Adam Putnam on Updated Citrus Crop Forecast, Need for Federal Assistance

Florida Commissioner of Agriculture Adam H. Putnam released the following statement today after the U.S. Department of Agriculture released its monthly citrus crop forecast for the 2017-2018 season:
“Florida’s iconic citrus industry and its growers continue to struggle with the unprecedented damage caused by Hurricane Irma. This damage, combined with the cumulative impacts of citrus greening, leaves Florida’s growers in desperate need of support. I will continue to work with Governor Scott and leaders in Washington to get Florida’s growers the relief they need to rebuild and replant.”
The USDA’s forecast today of 46 million boxes of oranges for the 2017-2018 season, unchanged from the December estimate, is down 8 million boxes from the 54 million boxes predicted at the start of the season.
In the wake of Hurricane Irma, Commissioner Putnam announced that Florida citrus sustained more than $760 million in damages. In the weeks following Hurricane Irma, Commissioner Putnam joined Governor Rick Scott in Washington D.C to discuss the agricultural damage and to request federal assistance with Florida’s Congressional Delegation.

Florida winner claims $450 million MEGA MILLIONS® jackpot
