Gov. Scott: Nursing Home Should Explain Why They Didn’t Call 911

TALLAHASSEE, Fla. – Today, Governor Rick Scott made the following statement regarding the Rehabilitation Center at Hollywood Hills, where 11 people lost their lives in the wake of Hurricane Irma due to the facility’s inaction to call 911 or evacuate their patients to one of Florida’s largest hospitals located directly across the street.

Governor Scott said, “It’s an absolute shame that this facility continues to not take any responsibility for the deaths of 11 people. This nursing home is directly across the street from a hospital, making their failure to evacuate or call 911 in a timely manner completely inexplicable and inexcusable.  

“Any health care professional that thinks calling an elected official’s cell phone instead of 911 when people are in need should not be allowed to have any access to patients. Because of their inexplicable failure, I have taken aggressive action to suspend their license and remove them from the state’s Medicaid program. Every child knows that when there is imminent danger, 911 is the number to call. Yet, trained health staff at this facility didn’t even do that. No one has offered an explanation for why the nursing home allowed these patients to perish, why they failed to call 911 until it was too late or why they failed to evacuate patients in danger to the hospital directly across the street.

“Thus far, the owners and operators of this facility have offered no explanation or defense for the deaths of these patients in their care, other than to say they left messages on my personal cell phone. The nursing home administrators placed four separate calls to my cell phone, like hundreds of others did during the storm. In each instance, the calls were promptly returned by state officials, and the voicemails were immediately deleted so the voicemail box had room for more incoming messages. In none of these calls did the staff indicate that any of their patients were in danger. I gave my cell phone number out as a courtesy to any group during the hurricane that needed access to state resources. It’s a ridiculous and irrational suggestion that my personal cell phone is somehow a substitute for 911. 

“There were over 100 nursing homes that reportedly lost power during Hurricane Irma, but this is the only facility that allowed patients to die. I fully expect that those responsible for these senseless deaths will be brought to justice, and a criminal investigation is well underway by the Hollywood Police Department with the help of the Florida Department of Law Enforcement. Nothing can hide the fact that this health care facility failed to do their basic duty to protect life and the state will aggressively continue to hold this facility accountable.”

As the Governor’s Office has said, the voicemails were immediately deleted once the information was collected by staff and transmitted to the appropriate agency for handling, which is in accordance with Florida’s public record law and record retention policy. Each call was quickly returned. The information collected from the voicemails was released to the public last week along with more than 150 pages of documentation, including emails, notes, call log information and other relevant records (available HERE).

Gov. Scott Directs AHCA to Terminate the Rehabilitation Center at Hollywood Hills from Medicaid Program

After the loss of eight lives at the Rehabilitation Center at Hollywood Hills, Governor Scott directed the Agency for Health Care Administration to terminate the facility as a Medicaid provider.
This facility was responsible to provide their patients a safe environment and they failed to do so. The state has had multiple points of contact with this facility prior to the tragedy, and at no time did the facility communicate any imminent threats to their patients’ life or safety.
This facility is currently undergoing a criminal investigation from the local authorities, and open investigations from both AHCA and DCF.  It is clear that this facility cannot be responsible for Florida’s vulnerable patients, and therefore the State will stop them from providing care.
Anyone found to not be acting in the best interests of their patients will be held accountable to the fullest extent of the law.
All patients have been evacuated from the Rehabilitation Center at Hollywood Hills.

Nelson asks HHS, CMS to take necessary steps to prevent future tragedies

Sen. Bill Nelson sent the following letter today to HHS Sec. Price and CMS Admin. Verma following the death of eight seniors at a nursing home in Hollywood, Florida yesterday.

Dear Secretary Price and Administrator Verma,
In response to yesterday’s disturbing news that at least eight seniors in Florida died in a nursing home with no air conditioning, I am writing to urge you to take steps to prevent similar tragedies as the state recovers from Hurricane Irma and future natural disasters.
The 152-bed facility located in Hollywood, Florida received a below average rating on a Centers for Medicare & Medicaid Services website responsible for rating facility quality, with its health inspection rated as “much below average.” Notably, a March 2017 health inspection found 11 deficiencies at the facility, well above the national average. Likewise, Florida’s Agency for Health Care Administration has given this facility a ranking of one star—its lowest ranking—for the facility’s overall inspection, the quality of care provided, and the quality of life of its patients.
Further reports indicate that the facility had a generator, but it is unclear whether it was working during Hurricane Irma. Records from a 2016 unannounced recertification survey indicate that the Rehabilitation Center at Hollywood Hills had a temporary generator that failed to meet code requirements. Specifically, the nursing home had no “written documentation to substantiate the emergency generator…had been replaced nor had plans for a permanent generator installation been submitted as required by the letter from Office of Plans and Construction.” While the facility responded by submitting a correction plan and allegedly planned to obtain a permanent generator, it is unclear whether they in fact did so.
As I mentioned to Secretary Price on the phone, I am even more troubled that there was a functioning hospital across the street from the nursing home, and yet these residents remained trapped in extreme temperatures for multiple days.
Seniors in nursing homes are among the most vulnerable and depend on facility staff for care and protection. Failure to transfer them to a hospital some fifty yards away is unforgivable. Moreover, this facility has a history of higher than average deficiencies, below average ratings, and inadequate emergency preparedness plans.
I urge you to hold those responsible for the deaths at the Rehabilitation Center at Hollywood Hills accountable and ensure that sufficient safeguards are in place to prevent a similar tragedy from happening in the future.

AHCA Issues Emergency Moratorium for the Rehabilitation Center at Hollywood Hills

Governor Rick Scott directed the Agency for Health Care Administration to issue an emergency moratorium for the Rehabilitation Center at Hollywood Hills.

All patients have been evacuated from the Rehabilitation Center at Hollywood Hills. This moratorium immediately prevents this facility from admitting any patients until it is lifted, and it is necessary to protect the lives and the safety of frail elders. Governor Scott made it clear today that he is demanding answers on and had ordered the Agency for Health Care Administration and the Department of Children and Families to immediately investigate this facility.
