ICYMI: Sunshine State News: Tear Down the Wall and Let the Free Market In

With the business of the legislative session last week, you may have missed a timely opinion editorial authored by Christian Cámara, Southeast Regional Director of R Street Institute. His piece ran on Sunshine State News and is entitled, “Tear Down the Wall and Let the Free Market In.”

In the column, Cámara advocates for a repeal of the costly, outdated Alcohol Separation Law, which would embrace free market principles and reduce governmental overregulation. He touches on the ironic liquor innovation by opponents of the legislation, stating other companies should have the same flexibility.

ABC Fine Wine & Liquors, Florida’s largest alcohol retail chain, struck a deal last year with a mobile app service to start offering one-hour alcohol delivery with the click of a smartphone. 

Announcing the new partnership, ABC CEO Charles Bailes III declared: “Convenience is everything … we are providing our guests multiple options for delivery. Everyone has different needs and preferences, and we want to ensure our guests will have an option that is compatible with their lifestyle.” 

I agree with him wholeheartedly. So long as this innovative method to sell alcohol to willing consumers is done legally, responsibly and includes safeguards against sales to minors, then I say “cheers!” 

Ironically, however, ABC is among the loudest voices opposing a sensible, bipartisan bill in Tallahassee that would allow grocers and other big-box retailers to sell liquor in the same store as food, beer, wine and other goods. 

Currently, if a grocery-store chain or other retailer wants to expand their alcohol selection from beer and wine to other kinds of liquor, Florida law requires it be sold in an entirely separate retail location. This Prohibition Era red tape foists needless expense on businesses, as well as inconveniences shoppers.  

I salute ABC for its innovation. They understand their customers are growing more accustomed to the benefits of online shopping, and want to maximize their convenience. ABC and other retailers need to adapt to market realities in new ways and I would be the first to defend them should any nanny-state, big government politicians attempt to undermine their efforts to do so. 

Unfortunately, in the current debate before the Legislature, ABC and a few others are the ones fighting giving other retailers the flexibility to sell other kinds of alcohol. This practice is legal in 29 other states, making Florida the outlier.  

I’ve always believed in a free market approach, and this issue is no different. HB 81 and SB 106 are not mandates. Retailers who prefer to stick with their current business models — whether that’s a separate store for liquor or one-hour mobile delivery — can do so. But the time has come to replace outdated, expensive regulations and give consumers more options. 

ABC has been able to innovate without government interference, and other companies should be able to do the same.

Our nation is in the grip of a deadly opioid epidemic.
An estimated 144 Americans die each day from drug overdoses. Many of them are Floridians.
The statistics are staggering. The Centers for Disease Control and Prevention reports that in 2015 more than 33,000 people in the United States died from opioid overdoses. More than 3,000 of those deaths occurred in Florida.
This epidemic must stop.
Running for attorney general in 2010, I heard countless stories from parents of deceased teens who overdosed and died after taking prescription drugs.
By the time I took office in 2011, the state was in a full-blown pill mill crisis. Ninety-eight of the top 100 oxycodone dispensers lived in Florida. Our state was known nationwide as the pill mill capital of the country.
The Florida legislature is considering cutting $50 million from mental health funding and the Sun Sentinel Editorial Board discuss how it can affect the state.
Something had to be done.

While in Washington to moderate women’s empowerment panel at the White House, Florida Attorney General Pam Bondi was named to a group who will take the lead on combatting drug abuse. The new group is called the Opioid and Drug Abuse Commission. It is a new group that was put together and will be overseen by President Donald Trump.
The commission will be chaired by New Jersey Gov. Chris Christie and today at the White House Bondi had some early conversations about her duties when she sat with Education Secretary Betsy DeVos, Attorney General Jeff Sessions, VA Secretary David Shulkin, Kellyanne Conway, Jared Kushner, Stephen Miller, Omarosa Manigault, and other administration officials.

ICYMI: 400 Floridians Attend Constitution Revision Commission Public Hearing in Orlando

The Constitution Revision Commission (CRC) held its first public hearing on March 29 in Orlando at the University of Central Florida (UCF) as part of its, “Floridians Speak, We Listen” statewide tour. Approximately 400 Floridians attended the hearing, and more than 95 individual Floridians spoke before the Commission to share their ideas. The hearing began at 5:00 PM and extended past the noticed end time through approximately 9:00 PM. All Floridians who attended the public hearing and wanted to speak were given an opportunity to be heard by the Commission.
To watch last night’s full hearing, visit the Florida Channel’s website which has a page dedicated to all CRC public hearings and meetings. A complete transcript of the public hearing and appearance forms will be available online at FLCRC.GOV as soon as possible. The next public hearings held by the CRC will be on April 6 at Florida International University (FIU) in Miami and on April 7 at Florida Atlantic University (FAU) in Boca Raton. The Commission meets for approximately one year, traveling the State of Florida, identifying issues, performing research, and possibly recommending changes to the Constitution. ICYMI: MaryLynn Magar statement on high-speed rail bill

Yesterday, House Bill 269, sponsored by Representative MaryLynn Magar, was temporarily postponed in the House Transportation and Infrastructure Subcommittee. The bill would establish a statewide framework for dealing with safety and maintenance costs associated with high-speed rail.
State Representative Magar made the following statement regarding the bill:
“This bill would have clarified that the costs associated with crossing upgrades and maintenance is the responsibility of the rail company, not state or local governments.
“All Aboard Florida calls this a ‘privately funded project,’ yet the project is shifting the costs of required safety upgrades and maintenance of their rail system to the local governments. Indian River and Martin County’s fiscal impact study found the costs of safety upgrades in the millions of dollars, and all of these costs are to be borne by the taxpayers throughout the life of the All Aboard Florida system.
“Although this bill has been temporarily postponed, my co-sponsors and I will continue to work with stakeholders, constituents, and fellow legislators to move this issue forward.
“It is unfortunate that All-Aboard Florida says that this legislation will kill jobs. This bill simply asks that All-Aboard Florida pay for their rail system and not place the burden on the backs of local governments and the taxpayers of Florida.”
